Starting a Recruitment Agency in Kerala: Emigration Act Registration and Compliance

Spread the love

Kerala sends more workers abroad than almost any other state, and recruitment for overseas employment is a significant business here. It is also one of the most closely regulated. Under the Emigration Act, 1983, no person can recruit Indian citizens for employment abroad without a valid registration certificate as a recruiting agent, and recruiting without one is a criminal offence.

This article explains the registration a recruitment business needs, and the structure and compliance that usually apply.

Overseas recruitment: registration as a recruiting agent

  1. Registration is granted by the Protector General of Emigrants, Ministry of External Affairs, through the eMigrate portal.
  2. The applicant may be an individual, a partnership firm, an LLP or a company, and must meet the eligibility conditions in the Emigration Rules, including financial soundness and suitable office premises.
  3. A bank guarantee of the prescribed amount must be furnished before the certificate is issued.
  4. The certificate is issued for a fixed period and must be renewed.
  5. Service charges that can be collected from emigrants are capped under the Rules, and receipts must be issued.

Domestic placement agencies

A business that places candidates only within India does not need registration under the Emigration Act. It needs the general business registrations below and should follow labour laws applicable to its staff and to any workers it deploys to clients.

Other registrations

  • Incorporation as a company or LLP, or registration of a partnership firm. See company registration in Kerala.
  • GST registration; recruitment and manpower services are taxable. See GST registration.
  • Shops and establishments registration and professional tax
  • Registration under labour laws where workers are deployed to clients

Practical points

  • Verify every foreign employer’s demand letter and power of attorney before advertising vacancies.
  • Advertisements for overseas jobs must carry the registration number of the recruiting agent.
  • Keep records of every candidate, fee received and placement, since they are inspected.
  • Use written agreements with foreign employers covering salary, accommodation, return travel and the employer’s obligations.
