Kerala Startup Mission and Startup Recognition: Eligibility and Benefits
A business in Kerala that is building an innovative product or service can be recognised as a startup at two levels: by the Department for Promotion of Industry and Internal Trade (DPIIT) under the Startup India programme, and by the Kerala Startup Mission (KSUM), the state government’s nodal agency for startups. Recognition opens access to tax benefits, government schemes, incubation and funding support.
This article explains who qualifies, how recognition works, and the points to consider before applying.
Who can be recognised as a startup
| Condition | Requirement under DPIIT recognition |
|---|---|
| Form of entity | Private limited company, LLP or registered partnership firm |
| Age | Up to 10 years from the date of incorporation or registration |
| Turnover | Not exceeding ₹100 crore in any financial year since incorporation |
| Nature of work | Working on innovation, development or improvement of products, processes or services, or a scalable business model with potential for employment or wealth creation |
| Origin | Not formed by splitting up or reconstructing an existing business |
A sole proprietorship does not qualify, which is one reason founders who intend to seek recognition usually incorporate a company or an LLP. See company registration in Kerala and LLP registration in Kerala.
How recognition works
- Incorporate the company or LLP, or register the partnership firm.
- Apply for DPIIT recognition on the Startup India portal, with a brief description of the innovation and supporting material.
- Register with KSUM on its portal, where state recognition and access to Kerala’s schemes generally build on DPIIT recognition.
- Apply separately for specific benefits, such as the income tax exemption, which needs certification by the Inter-Ministerial Board.
What recognition offers
- Tax: eligible startups may claim a deduction of profits for three consecutive years out of their first ten, subject to certification and conditions.
- Intellectual property: fast-tracked patent examination and reduced fees for patents and trademarks.
- Regulatory: self-certification under certain labour and environment laws for a period.
- Public procurement: relaxation of prior turnover and experience conditions in many government tenders.
- KSUM support: incubation at KSUM facilities and partner incubators, innovation and product development grants, and programmes connecting startups with investors and government departments.
The exact benefits, amounts and conditions change from time to time and should be checked on the Startup India and KSUM portals before applying. See also eligibility for Startup India recognition.
Points to consider
- Recognition depends on the innovation described. A conventional trading or service business is unlikely to be recognised.
- Investment from investors, especially from abroad, brings FEMA requirements. See FDI in private limited companies.
- A shareholders’ agreement and clear founder arrangements are expected by most investors. See drafting a shareholders’ agreement.
- Recognition does not reduce company law compliance; annual filings continue as usual.
